C3C

C3C: City Commuters club, is an exclusive community to address the needs of city Commuters. The ‘3’ in C3C is the symbol for C3C Commuters to initially identify each other. 3 fingers will be waved at, by each other to identify when C3C Commuters meet, then they can verify each other’s profile through mobile app with a tap or using QR code and decide on boarding for rides.
Commuter: Ride giver or Ride taker is called a Commuter
Mutual rating system: The Ride giver and the ride seeker shall rate each other.
Point:

At City Commuters club, a ‘Point' is the fundamental quantity to barter. One C3C Point is (approximately) equivalent to 1 Indian Rupee of commute expense ( fuel saved, depreciation and maintenance of vehicle) by way of collaborative commute.

● At C3C, we aim to compensate the User offering the ride with Points equivalent to the total cost of fuel for the ride (in INR) as a whole (For the C3C system in entirety). The total cost is calculated in terms of Points equivalent to fuel expense per kilometer.
● The Points accumulated by Ride giver can be used by him (or her) and or his (or her) family (or friends). They can use these Points for availing a similar ride. These Points are transferable from one User to the other. They can avail any number of rides if they have sufficient number of Points in their wallet.
● The number of Points transferred per kilometer in a ride varies from Vehicle to Vehicle.
● C3C shall charge 10% of the points in any transaction between users of C3C platform as the service charge for providing the platform.
● One point is about INR 1 worth of fuel saved per user compared to single driver vehicle, This explanation is for indicative pupose only and does not bind on C3C.
● C3C shall not provide any monetory benefits for the users of C3C for using its services. The users shall only use the points for availing the available rides on C3C platform .
Ride giver : The person who offers the ride is the Ride giver
Ride taker: The person who avails the ride is the ride seeker
Ride sharing: When several people travel together by a Vehicle and share the cost of the commute, it is called Ride sharing.
Site: http://www.C3C.in/ is the Site
User: Person who registers on the Site http://www.C3C.in/ is a User
Vehicle: The car or bike used for ridesharing is the Vehicle
Wallet: The page in a C3C User’s profile where the Users’ Points and transactions (in Points) can happen.

Acceptance of conditions

The conditions are applicable to all the Users. By becoming Users, they agree to the conditions and are bound to the conditions.
Access to the Site is allowed if and only if the Users agree to all the conditions. The Users may not use the Site if they do not want to agree to the conditions or do not want to abide by them. In case, any User does not abide by the conditions, C3C reserves the right to question that User or withdraw the services to that User without notice.

Subjective conditions

The conditions are subjected to change at any Point of time. Also, the Site content, the Site and the services are subjected to change. There might not be any prior notice and liability to the Users regarding the changes.
The changes made will be in effect, after they are posted on the Site. Also, the Users might be notified through an e-mail in case of any material changes to the conditions.
The Users shall continue to be Users only if they abide by the changed set of conditions. The changes are applicable only to the activity that takes place after the changes have come into effect.

USE OF THE SERVICE

Account of the User and accuracy of information

Users can avail themselves with the services by creating a C3C profile on the Site. Users shall provide their personal information including first name, last name, email id, mobile number, password, organization, home and work locations.
● The User shall also certify that the User is above 18 years of age by creating an account and agreeing to the terms and conditions.
● By filling in the personal information, the person agrees that the information provided is true, complete and accurate. Also, the User agrees that any other information provided by the User to C3C or via C3C with regard to services in any manner is true, complete and accurate.
● Users agree that C3C verifies the information provided by every single User through mobile number verification (SMS OTP) and Mail ID verification. By default, a User can create and use only one account. A User shall not create an account on behalf of some other person. In case of breach of conditions, C3C reserves the right to restrict the User from accessing the Site or making use of the services.
● A User shall verify that the details provided about his Vehicle are genuine by uploading relevant proofs such as the Vehicle registration details and RC book into the webSite

A just Ride sharing platform

Users shall avail themselves the services only in order to cater to their need of Ride sharing. Users shall not indulge in any commercial or professional activity of hiring or rewarding a ride. Users shall agree that they may not make any profit in any form during ridesharing. The Ride giver shall not offer any additional services other than Ride sharing for making a profit. The ride seeker shall not ask for any additional services other than Ride sharing. All the agreements between the Ride giver and the ride seeker, regarding the ridesharing have to be made through the Site. Making use of the Site in a commercial or professional context might lead to invalidation of the violating User’s insurance and legal actions taken against the violating Users. Users are solely responsible for the consequences for breach of conditions.
C3C is just a just Ride sharing platform. It does not offer any ride on its own rather provides an apt platform to offer or take rides. All the agreements made for sharing a ride are between the ride seeker and the Ride giver. C3C is liable to neither of them. Any breach of the conditions might result in the withdrawal of the account of the User and the Users might not be allowed to use the services any further.

Ridesharing Policy

After a genuine account is being created and validated, Users can avail/offer rides in the following manner:
● The Users shall give their source and destination Points as input. The various rides available in that route will be shown along with the details of the corresponding Ride givers. The number of Points required to avail that ride will also be shown.
● The Users have to select one among them and a notification will be sent to the Ride giver. The Users will have to board the Ride giver’s Vehicle at the prescribed source Point by checking relevant details like the driving licence and the insurance.
● After the destination is reached, the corresponding Points will be deducted from the Ride taker’s account and will be transferred to the Ride giver’s account. In this process, 10% of the Points deducted from Ride taker’s account will be taken away by the company and the rest will be transferred to the Ride giver’s account.
Availing a ride through C3C App:
● The procedure will be similar till the Ride taker chooses the Ride giver. The app notifies the presence of Ride giver around the Ride taker within a range of 10m through NFC (if available in your smartphone).
● At the end of the trip, the Points will be transferred by scanning the QR code in the Ride giver’s app through Ride taker’s app.
Offering a ride through C3C App:
● The Ride givers have to give their source and destination Points as input and the ride will be offered for next minutes, i.e., other Users can avail his ride within the next ten minutes only.
Note: The Users need not enter the source and destination Points every single time they avail/offer rides. They can opt for default ride(s) option which takes the default home (or source) location and default office (or destination) location which was given by the Users during registration, as input and triggers rides.
Availing a ride through SMS (incase of unavailability of a smartphone)
C3C will strive to make the Site up and running 24 x 7, but occasionally access to the Site may be restricted to allow for repairs, maintenance or the introduction of new facilities or services or not available for reason beyond C3C’s control. C3C does not accept any responsibility for any errors, omissions, or for the results obtained from the use of such information or for any technical problems which Users may experience with the Site. If a User detects a fault, please contact us and C3C will endeavour to correct the fault at the earliest.

Commuters’ pact

The Ride giver and the Ride taker shall not use the commute for any kind of unlawful activity. The Ride giver and Ride taker shall adhere to the agreement made for the commute. The Ride giver and the Ride taker shall present themselves at the decided place and time. The Ride giver shall use only that Vehicle that has been agreed upon for the commute. The Ride giver and the Ride taker shall immediately inform the counterpart about any changes that they would like in the commute.
Any violation of the pact might result in publishing the violated act on the corresponding User’s C3C profile or suspension of the corresponding User’s C3C profile. The violating User might be restricting from accessing the services any further.

Vehicle

The Ride givers shall accept that they hold a valid driving license and that they own the Vehicle or are allowed to use the Vehicle. The Ride givers also accept that the Vehicle has a Pollution Under Control (PUC) certificate. The Ride taker is entitled to request the Ride giver to produce the driving license, registration certification, PUC certificate of the Vehicle at anytime during the commute.

Insurance

User shall hold a valid insurance policy which covers for third party and co passenger’s liability for any accidental/incidental damage to during the ride. However , it is unto the users of C3C to verify the validity of insurance when with the user before boarding the ride.

Management of disputes

C3C is intended to be a co-operative of City Commuters. It facilitates Commuters of a city to network to overcome the woes of City commute - traffic,pollution,commute time and expense.
The Users of C3C are expected to be altruistic with regard to the above mission of the C3C User community. C3C Users shall behave in an appropriate manner with fellow C3C Users.
C3C platform shall provide its Users with a non-binding online messaging service for resolving disputes. C3C is under no obligation to seek to resolve disputes and this service is offered at C3C’s sole discretion and may be withdrawn at any time.
C3C obligation with regard to dispute between Commuters shall be restricted to the Points for the ride only. If any dispute is not settled, C3C reserves the right to retain any Points paid by the Ride taker until an amicable agreement has been reached between the Ride taker and the Ride giver or a definitive judicial decision has been made.

DISCLAIMER OF LIABILITY

Users shall create a C3C profile and use the Site and services at their own risk. The Users shall enter into pacts with the other Users with sagacity. C3C is not liable for any issues that result from the use of the Site or services. Also, C3C is not liable or responsible for any violation of conditions or actions of the Users.
C3C will take care to provide accurate content on the Site. But it will not be liable to any of the inaccuracies that might creep in the content or information on the Site. C3C does not support any User in any manner.
Whenever C3C users use our platform for sharing of the rides, they enter into an agreement with fellow users while availing/offering ride. C3C is not a part of any agreement between the Commuters .
Non liability to losses : C3C provides the platform for exchange of rides between riders. C3C will not be liable for any consequential, incidental, accidental, or any other losses that may arise to user , and it is upto the sole discretion of users to use the C3C platform .

INDEMNITY AND RELEASE

I hereby RELEASE FROM LIABILITY, WAIVE, DISCHARGE AND COVENANT NOT TO SUE e C3C - City Commuters Club, its holding comany/Companies, any of the officers, servants, agents and employees of the above-mentioned entities (hereinafter referred to as RELEASEES) for any liability, claim and/or cause of action arising out of or related to any loss, damage or injury, including death, that occurs as a result of my participation in C3C - The City Commuters Club .
I agree to indemnify and hold harmless the RELEASEES whether injury or damages is caused by my negligence, the negligence of the RELEASEES or the negligence of any third party. I further agree that this Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representatives, if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above-named RELEASEES. I hereby further agree that this Agreement shall be construed in accordance with the laws of INDIA.
For Using C3C.in 'City Commuters club' - its software, products and services,, I STATE THAT I HAVE READ AND UNDERSTAND THE CONDITIONS SET FORTH IN THIS TERMS OF SERVICE, PRIVACY POLICY, AND RELEASE FROM LIABILITY AND HOLD HARMLESS , THAT I AGREE TO ALL CONDITIONS SET FORTH HEREIN, AND THAT MY AGREEMENT IS VOLUNTARY.

SOME MORE TERMS

Relationship

C3C and its Users are not associated in terms of a business partnership, joint venture or other similar terms with respect to any sort of arrangement or agreements.

Restriction to Site access and services

Users shall agree that in case of violation of terms and conditions, they might be restricted to access the Site and avail themselves with the services without prior notification from C3C.

Copyrights

Any content included on the Site, such as text, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of C3C, its affiliates or its content suppliers and is protected by India and international copyright, authors' rights and database right laws.
All rights are reserved in relation to any registered and unregistered trademarks (whether owned or licensed to C3C) which appear on the Site. Any portion of the Site should not be reproduced, duplicated, copied, sold, resold, viSited, or otherwise exploited for any commercial purpose without the express written consent of C3C. No person is entitled to systematically extract and/or re-utilise parts of the contents of the Site without the express written consent of C3C.
In particular, the use of the concept of Points, data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilisation of any substantial parts of this Site is strictly prohibited.

Content provided to the Site by the Users

The user provides C3C , the right to display and use the content submitted by the user during on C3C or any of its partners sites for the purpose of extending services envisioned by C3C, marketing of C3C services, and improvmenet of any further features on C3C platform.

Partner Sites

C3C shall engage in partnership with other companies for the benefit of its users, and C3C shall share the users content with partner companies in the process of rendering the services envisioned by C3C. The user hereby accepts sharing of his information with C3C partner sites.

LAW AND JURISDICTION

These terms shall be governed by the law of India and any disputes arising in relation to these terms shall be subject to the jurisdiction of the Courts of Hyderabad.

Amendments to Terms and conditions

C3C is also entitled to amend the Conditions for Use of ‘City Commuters club - www.c3c.in ‘ Features at any time. Users will be informed of any such amendment by publication of the updated conditions on this website. Users are personally responsible for acquainting themselves with the updated conditions. A user’s continued use of C3C through www.c3c.in and its mobile app, and its Features after update of the conditions for use shall constitute his acceptance of the updated conditions. Should any user contest the updated conditions for use, C3C shall be entitled to exercise its rights as set out in this clause.
